Terms of Service

THE THRIVE PORTAL & RESTORE CHALLENGE

These Terms of Service ("Terms") govern your access to and use of The Thrive Portal or Restore Challenge services, and content (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms: By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, you may not access or use the Services.

2. Friendly Community Standards: In The Thrive Portal or Restore Challenge community, we value kindness, respect, and inclusivity. You agree to treat fellow community members with respect and courtesy, refraining from discrimination, bullying, harassment, or any other behaviour that may be harmful or offensive to others. We foster an environment where everyone feels safe and supported on their healing journey. Any violation of these community standards may result in the suspension or termination of your access to the Services.

3. ThetaSomatics™ Method: The Thrive Portal and Restore Challenge include proprietary modalities, tools and techniques taught as part of the ThetaSomatics™ method, which is protected by trademark law. You acknowledge that ThetaSomatics™ is a registered trademark and may not be used or copied without explicit permission.

4. Protection of Unique Modalities: The unique modalities taught in The Thrive Portal and Restore Challenge are the proprietary property of Get Wholethy LTD. You agree not to modify, copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any information, products, or services obtained from or through the portal without explicit written permission. These modalities are provided for your personal use only, and you agree not to use them for commercial purposes or to develop competing products or services. Any unauthorized use of these modalities may result in legal action.

5. Copyright: All content provided through The Thrive Portal and Restore Challenge, including but not limited to text, graphics, images, videos, and other materials, is protected by copyright law. You may not copy, distribute, or reproduce any content from The Thrive Portal without prior authorisation.

6. No Refunds: All purchases are final sale and refunds are not provided for previous months on the The Thrive Portal or Restore Challenge regardless of whether the student has logged in to view the content. Get Wholethy LTD maintains the right to refuse refund at any time or provide the option to take Get Wholethy LTD store credit to be used on future purchases. There may be occasional glitches with the Circle or Teachable apps or the websites which mean we experience downtime. Get Wholethy LTD will always work to resolve these outages as quickly as possible & report any bugs to Circle and Teachable. No refunds will be provided with temporary access issues with the app or downtime with the site.

7. Billing Policy: Our billing system is automated and we do not have the ability to freeze or skip payments or adjust the billing cycle for any of our members. Upon signup Thrive Portal members who choose the 12 month payment plan method will be billed automatically every 30 days. Those who choose the pay in full options will be billed once, immediately upon signup. If you are on the 12 month payment plan and have a failed payment, the system will retry to charge you once a week for 4 weeks. If your payment fails 4 times in a row your plan will be cancelled and access will end. For any cancelled plans due to failed billing, a member may reach out to Get Wholethy LTD at support@getwholethy.com to receive a direct link to a private plan which has the correct number of remaining payments if they do not want to sign up for another 12 month payment plan. In addition, if they had a reduced rate, they may request to receive a discount code in order to lock in their previous rate again. To qualify for a private plan and in order to receive their previous rate, the member must reach out requesting for their plan to be reinstated within 30 calendar days of their original Thrive Portal membership cancelling. Beyond 30 days of their membership cancelling, the member will need to repurchase a new 12 month Thrive Portal membership and will be susceptible to the current rate. When reinstating your Thrive Portal membership the only payment option available will be to pay monthly for those remaining months. Buying out your membership will not be an option for reinstatement.

8. Final Sale and Cancellation Policy: All purchases of The Thrive Portal and Restore Challenge content are final sale. Memberships, including those on a 12-month payment plan, cannot be canceled early due to a change in financial situation or for any other reason. Payments must fail in order for the plan to be canceled. This policy ensures that all commitments are upheld, and no early cancellations are permitted under any circumstances.

9. Non-Transferable Access: All purchases of The Thrive Portal and Restore Challenge content are meant to only be viewed by the purchaser and cannot be shared with others. Sharing of login credentials is strictly prohibited. All purchased content including written, video, and audio is only available to view by logging in with your registered account credentials and cannot be copied or downloaded to a personal device for viewing or listening offline. Upon purchase all customers acknowledge that they have denied the right to facilitate the use of the workshop material in private one-to-one sessions, either professionally or personally, with clients or others, for monetary gain or otherwise. Additionally, purchasers agree not to teach the workshop content to others in any way, to groups or individuals, professionally or otherwise, for monetary gain or otherwise. Purchasers further agree not to post any text or video presentations of Get Wholethy LTD material, or demonstrations on the internet, or other electronic media. Violations of this policy are considered unlawful and Get Wholethy LTD reserves the right to take legal action in cases of misconduct.

10. Access Duration: Upon purchase, you will have access to The Thrive Portal for a period of one year from the date of purchase. Or The Restore Challenge for 3 months. After this period, access may be renewed at your discretion.

11. Contact Prior to Purchase: For any questions or inquiries about The Thrive Portal, Restore Challenge or their services, please contact support@getwholethy.com prior to making a purchase.

12. Modification of Terms: Get Wholethy LTD reserves the right to modify these Terms at any time without prior notice. Any changes to the Terms will be effective immediately upon posting. Continued use of the Services after the posting of changes constitutes acceptance of the modified Terms.

13. Termination: Get Wholethy LTD may suspend or terminate your access to the The Thrive Portal, Restore Challenge or services at any time for any reason, without prior notice or liability.

14. Governing Law: These Terms are governed by and construed in accordance with the laws of England, The United Kingdom, without regard to its conflict of law provisions.

By accessing or using The Thrive Portal or Restore Challenge services, you acknowledge that you have read, understood, and agree to these Terms. Thank you for being a part of The Thrive Tribe community!
